Both authors agree that slavery was morally wrong and it almost brought the Union to its knees and the destruction of it. However, both authors have very distinct thoughts and reasons for it. I run to my fathers room, crying, and telling thatsomeone is in my room and I doesnt know why he was there. After my fathersolved the problem for me. We were all laughing about it. My father said, In the Philippines, eating with hands are their culture, youwill never see this in Taiwan. In Taiwan, everybody use chopsticks to eat. Nobody will use spoon and folk to eat, because thats a kind of hard. Just likemy first time used the spoon and folk. I doesnt know either to use my left handto hold spoon or use my right hand. People have longer weekend than Taiwan. Both Sunday and Saturday are theirweekend. In Taiwan, we can only have Sunday and half Saturday. For adults, theyeven only have Sunday to rest. Thats unfair to adults. They should have longerweekend then kids, because they worked so hard. So, adults most be exhaustedafter hard work. People are happy go lucky. They wouldnt care much money they earn each day. They wanted to have better life than earning more money. Whenever they got aserious problem, like no place to overnight, they were try to find a place tostay like bus station. But if they couldnt find it, they wont worry too much. Also, when Im in downtown, they always smile at me. They wouldnt care where Icame from. They were show me their music, dance and even acrobatics. I reallyenjoyed it, though I need to pay for it sometimes. In Taiwan, it is impossibleto see those shows. All they want is money, money and money. Walgreens customers receive an average of four prescriptions on monthly basis from the pharmacy (WAG Annual Reports, 2007). With 65% of the sales revenue of the company coming from the pharmacy, Walgreens declines to bargain with out-of-pocket customers over price. Regardless of a climbing prescription drug-price trend, demand remains elastic because customers demand choices of similar, less expensive medications if authorized by their doctor. The amount of reimbursement Walgreens receives from Medicare, Medicaid, and Worker’s Compensation falls drastically, as incremental revenues from those sources decreases (Stewart, 2006). According to Lueck, â€Å"Medicare and Medicaid comprise 25 percent of the federal budget, and the government cannot afford to spend at the current rate† (Lueck, 2008). Tom Charland, CEO of Merchant Medicine, in his prophetic wisdom forecasted an â€Å"increased scarcity of physicians and midlevel practitioners in many markets and the increased use of pharmacists. † (Berman, 2007) This justifies the idea that most baby-boomers will spend several hours a week in doctor’s offices receiving treatment for maladies that require prescriptions. Because of meager prescription profits, customers gain little when switching from one pharmacy to another. As Jeff Rein, VP of Walgreens, understands, â€Å"95% percent of our patients pay only the co-pay required by their insurance plans. † (WAG Annual Report, 2007) This removes Wal-Mart’s $4 prescription plan from the picture. POWER OF SUPPLIERS In Porter’s words, suppliers with power â€Å"can squeeze profitability out of an industry that is unable to pass on cost increases in its own prices. (Porter, 2008) To make up for excessive inventory costs for new medication Walgreen’s must decrease labor hours and work more efficiently. For corporate executives in retail pharmacies like Mark Wagner of Walgreens, â€Å"the end solution is to cut costs†¦and the biggest cost in stores is payroll. † (Merrick, 2008) With manufacturers keeping new FDA-approved substitute (generic) medications at bay by creating expensive time-released versions of the ori ginal, retailers spend more money than ever before on shelf space (Merrick, 2008). The following demonstrates a sample of what Porter means by suppliers having power when they â€Å"offer products that are differentiated† (Porter, 2008). In March 2008, analysts at Citigroup Inc. announced, â€Å"AstraZeneca will have more time to market the product†¦Seroquel XR, a once-daily version of the [original] drug†¦ slowly [converting] patients to the patent-protected drug before a generic version of Seroquel becomes available† (Merrick, 2008). Generic companies defending their rights to enter the market state brand name manufacturers received patents through inequitable conduct (Merrick, 2008). Alan McNally, Walgreen’s new CEO as of October 22, 2008, justifies the use of POWER so â€Å"the company’s founding base of competitive advantage will bring vital market share, stockholder optimism, and customer sentiments of timeliness and prescription safety back to Walgreens† (WAG Annual Reports, 2008). Despite Walgreens’ ability to gain back market share by utilizing POWER, this evolution of problem-solving workflow is the company’s first major step in â€Å"creative destruction. Since an estimated â€Å"25-30% of work in the pharmacy originates from processing and troubleshooting third-party claims†, Walgreens shows no sign of maintaining current hourly needs for technicians when POWER operations begin (Merrick, 2008). The excess reserves saved from this venture will allocate finances for greater stockholder dividends and ensure the company’s progressive movement into staying one-step ahead of the competition (Merrick, 2008). Acc ording to the 2008 annual reports released in November, the salary expenditures saved from cutting technician hours will help support funding for the accumulated $1. billion dollar long-term debt in 2008 (WAG Annual Reports, 2008). Formerly discussed in the section, â€Å"Power of Suppiers†, Walgreens showed vulnerability to brand-name manufacturer’s new formulations marketed to physicians as more effective and safer than their FDA-approved generics. The county’s nation-wide recession that tumbled into a worldwide pandemic has been reason enough for many consumers to forgo reinstating their prescription insurance plans in 2009 and instead shop around for bargain generics (Lueck, 2008). Porter describes the country’s turmoil perfectly by announcing America is in the â€Å"Age of Anxiety,† as he reminds readers that in the US â€Å"restructuring destroys about 30 million jobs per year† (Porter, 2008), To combat consumer demand for lower cost prescriptions, Walgreens has aggressively marketed the Walgreens Drug Program in 2008. This discount program offers consumers the option of choosing from a list of 400 price-approved and quantity-approved generic medications at a 90-day supply for $12 (WAG Annual Reports, 2008). To attract customers to less expensive and more readily available generic medications, Walgreens built the discount rogram to show how much each customer can save while receiving a therapy that is exactly or similar to what their doctor prescribed. The only cost associated with this plan is a one-time $20 fee for using the service pennies compared to the hundreds of dollars each month otherwise spent on prescription healthcare covera ge. The idea of Walgreens creating healthcare clinics where customers can go and receive treatment for common symptoms arose from competitor initiatives to capture a segment of the market not dominated by Walgreens. The purpose of this tactical approach was to lessen the force of rivalry in the industry. As of November 2008, Walgreens â€Å"operate[s] more than 600 health and wellness clinics in our stores and on employer worksites [with] plans to expand to 800 sites by the end of fiscal 2009 (WAG Annual Reports, 2008). While data on this new mode of investment has not been conclusive or forecasted in expected yearly revenue, Walgreens intends on honing company expansion in this market to counter aggressively competitor initiatives. Nauseated vs. Nauseous Nauseated vs. Nauseous Nauseated vs. Nauseous By Maeve Maddox A reader sent me this request: Would you please do a blast-out about the word nauseated versus nauseous? The noun â€Å"blast-out† is new to me, but I presume it means something like the following: a strongly worded admonition to English speakers to get the difference between these two words straight once and for all, blast it! The more I research usage and write about it, the less inclined I am to blast out about anything, especially word pairs like nauseous and nauseated. The supposed distinction is that people are nauseated, whereas nasty, disgusting things are nauseous. For example, women in the early stages of pregnancy often feel nauseated. A stagnant pool of foul-smelling water is nauseous. The OED gives two definitions of the adjective nauseous: 1. Of a thing, causing nausea. 2. Of a person, affected with nausea. For at least 179 years, English speakers have been using nauseous in the sense of â€Å"feeling the urge to throw up†: In speaking of the effect of bloodletting, Mr. Lizars says that ‘the patient feels nauseous and sick even to vomiting’. (OED citation dated 1836). A search on the Ngram Viewer of â€Å"feel nauseated† and â€Å"feel nauseous† shows a convergence of both terms in 2000. In popular usage, nauseous is frequently used to mean nauseated, whereas nauseating has largely replaced it to describe disgusting objects or odors: Drivers of General Motors popular Chevrolet Cruze sedan are complaining that the vehicles new car smell is a  nauseating stench. Everyone’s entitled to defend a preferred usage, even one that’s clearly headed for extinction. One of my own language peeves is to hear the word disinterested in a context that calls for uninterested. In my heart-of-hearts, I know it’s a distinction that goes unobserved more often than not, but I’ll continue to observe it in my own writing and to recommend it to others. Speakers to whom the distinction between nauseous and nauseated is important should observe it in their own speech and writing. Insisting that everyone do it is futile. Like civil public discourse, careful language has become a minority value. Those who care about it don’t need to be blasted; they need only to be informed. Family Trusts Law Problem Question This question concerns the law of trusts in the family home. Specifically, Mary requires advice on two questions: whether Philip is entitled to a share in the property, 8 Emerald Way, and whether she is able to sell the house now that she and Phillip have split up. TRUST OF THE HOME The starting point in any case is the identity of the legal owner. Here, the property is in the name of Mary. The prima facie position is that she also controls the beneficial interest[1]. Phillip has two arguments that could be used to claim part of the beneficial interest. The first, and stronger, is that there was an agreement that they should beneficially share the ownership. The second is that he has made direct contributions which lead to a presumption of a resulting trust. CONSTRUCTIVE TRUST This argument centres on a claim that when the title was put into Mary’s name, there was a common intention to share the beneficial ownership. Philip has only one way of demonstrating such an intention; the reason given for placing the property in Mary’s name. In Eves v Eves[2] the man put the property in his name, giving as an excuse that the female was under 21. Likewise another man claimed reasoned that it would prevent adverse effects on her divorce proceedings[3]. In these cases it was held that, but for the excuse, the property would have been registered jointly. Here, the excuse given was that to place it in Philips name would leave a trail for creditors to follow should his business run into trouble. This would appear to satisfy the Eves[4] and Grant[5] authorities except for a distinguishing feature. It appears that it was Philips suggestion and as such there may be a counter-argument stating that this is not a proper excuse case. The rationale of the authorities suggest that the courts would find that there was an intention that both would have ownership and that only the excuse prevented both being entered on the legal title. Philip would also have to show that he acted to his detriment. The courts have been imprecise on the requirements to satisfy this point. In Grant[6] a partner had contributed to the general expenditure which freed up money to pay the mortgage instalments. She was entitled to a share. In Lloyds Bank v Rosset[7] the House of Lords[8] said that merely maintaining the house would not entitle a partner to a share. In Hammond v Mitchell[9] the partner acted as an unpaid assistant to the business which again was an indirect contribution that was rewarded with a share of the beneficial interest. In this case Philip has paid for the new car; paid expenses for the house, and paid for the holiday to Corfu. While none of these are direct payments to the mortgage, all of them are payments which allowed Mary to pay the mortgage payments. Therefore, Phillip has a strong case under Grant[10] that he should be entitled to a share in the beneficial interest. RESULTING TRUST If the court were to find against Philip on either of the above points, he may still claim that a resulting trust arose. He would have to establish that he contributed money to the purchase price of the house. In Springette v Defoe[11], the court ruled that either an original contribution or contributions to the mortgage will suffice. In this case he has not contributed directly to the mortgage. When the house was initially purchased, the couple paid a 5% deposit, in real terms  £5,000. If he contributed anything towards this then he will be able to establish a direct contribution which will entitle him to a beneficial interest. THE SPLIT OF THE BENEFICIAL INTEREST Mary should also be advised on the possible divide that the courts will make should Philip prevail in demonstrating a beneficial interest. Traditionally, for a financial contribution the courts tended to follow the division of the contributions. Since Drake v Whipp[12] this has been less certain with the courts adopting, in their own words, a â€Å"broad brush† approach. In that case, a 20% contribution was rewarded with a 33% beneficial interest. In Drake[13] the distinction between a common intention trust and a resulting trust was emphasised, with an equal split being more likely in the former. She should be warned though that it is possible for Phillip to be awarded an equal share of the property. THE PROBLEM OF SALE If Phillip has a beneficial interest Mary will be a trustee for herself and Phillip. Phillips reaction to an attempted sale will be important. If he consents then naturally there will be no difficulties. If Phillip objected then the crucial point would be the existence of one trustee. Mary would be unable to use the overreaching rules contained in the Land Registration Acts[14]. Mary could still attempt to sell the property but Phillip could attempt to block the sale by seeking relief under section 14 of the Trusts of Land and Appointment of Trustees Act 1996. This gives the court a wide discretion to grant an injunction. Given the discretion, it is difficult to predict whether Mary would prevail. The court would take into account the original intention of the parties when purchasing the parties, as well as individual factors that are case dependent.[15] CONCLUSION Mary should be advised that it is likely that Phillip will be awarded a share in the beneficial interest, either by way of common intention trust, or a resulting trust. If Phillip objects to the house being sold, he could seek an injunction pursuant to section 14 of TOLATA. Revolution and reformation; these are two words that are often identified with war, disagreement, and regional effects. While these things do indeed come along with a revolution or reformation, they heed an array of positive and secular outcomes as well. In addition, a revolution can, and usually will, cause a reformation. Conversely, a reformation can cause a revolution. This can happen despite the two things involved with the change or disagreement being seemingly unrelated.
